Mediation in Ireland

Ireland has recently awoken to the contribution mediation can make to a just and fair society. The legal profession has been slow to realise the potential of mediation to deliver meaningful outcomes for clients. Any dispute can be submitted to mediation where the parties are in agreement and no special permission or consent is required. In recent years the Irish legislature has systematically inserted provisions into our laws to encourage, facilitate and prescribe mediation.

By agreement any dispute can be Mediated

Mediation is not restricted to disputes which have become the subject of litigation. It can be effective in resolving conflict within organisations and institutions and has a special role in resolving family, relationship and community conflicts.  

In the commercial world mediation can assist in resolving many disputes including employment, partnership and joint venture disputes.

At a community level Northside Community Law Centre is developing an innovative mediation service www.nclc.ie , while Just Sports Ireland operates a Sports Tribunal which includes mediation among its solutions menu.

The Irish Law Reform Commission has published a very comprehensive consultation paper on alternative dispute resolution, which includes a section on mediation. The paper, LRC CP-50 2008, can be accessed at www.lawreform.ie .
